Can UAE Employers Deny Your Summer Leave Requests?
If you are planning a long summer break, you might be surprised to learn that your employer has the legal authority to decline your leave request if it conflicts with company operations. Under the UAE Employment Law, annual leave isn't entirely at an employeeâs discretion; instead, the law empowers businesses to schedule time off based on operational needs. Employers often use a rotation system to ensure that staff shortages during busy periods or holiday seasons do not disrupt the smooth progression of work.
According to Article 29 of the UAE Employment Law, companies are permitted to set leave dates in agreement with the employee to maintain productivity. While the law does grant you the right to your entitled time off, it also mandates that employers must notify staff of their scheduled leave at least one month in advance. Crucially, while your boss can deny a specific request due to staffing concerns, they cannot prevent you from taking your accrued leave for more than two consecutive years. To avoid conflict, the best approach is to have an open, proactive discussion with your management to find a mutually convenient window for your vacation.
