The UAE Federal Supreme Court has officially quashed a death sentence handed down to a man convicted of murder, citing a critical failure in the judicial process. While the defendant was originally found guilty of using scissors to fatally stab a woman and attempting to kill another man in their residential building, the country’s highest court ruled that his right to a fair defense was compromised. Because the appellate court neglected to address essential arguments raised by the defense—including claims regarding a lack of premeditated intent and requests for a psychiatric evaluation—the Supreme Court has ordered a complete retrial. The case must now be heard by a different panel of judges to ensure that all substantive legal points are thoroughly examined.

The decision underscores the court's strict commitment to the right to defense, particularly in capital cases where a mandatory review is required under Article 253 of the Criminal Procedure Law. The defendant had previously challenged his sentence, arguing that he did not intend to commit murder and that his mental state at the time of the attack necessitated further investigation.
