UAE Court Overturns Embezzlement Conviction Due to Unreliable Digital Evidence
An Ajman appeal court has officially cleared an Egyptian woman of embezzlement charges, overturning a previous conviction that had initially resulted in a fine. The woman, a retired dentist, had steadfastly denied ever knowing the complainant or receiving any funds from him. Upon reviewing the case, the appellate judges found the complainant's claims to be riddled with inconsistencies, noting a complete lack of credible documentation or witness testimony to support the allegation that a transaction ever took place.
The defense team, led by Dr. Hasan Elhais, successfully cast significant doubt on the digital evidence presented in the case. The WhatsApp screenshots submitted by the complainant contained irregularities, such as missing international dialing codes, which suggested the images might have been digitally manipulated. Furthermore, prosecutors failed to produce forensic verification linking the messages to the defendant’s phone. Emphasizing that criminal convictions require absolute certainty rather than mere suspicion, the three-judge panel unanimously ruled that the insufficient and unreliable nature of the evidence necessitated a full acquittal.
