Originally introduced through a temporary proclamation, this steep financial barrier is now undergoing a 30-day public comment period to be established as a permanent regulation. While the administration argues that these measures are necessary to protect American labor, the proposal has drawn immediate backlash from major business groups, unions, and various states, many of which are already embroiled in ongoing legal battles to block the fee.

Critics of the policy, including the U.S. Chamber of Commerce, contend that the government lacks the constitutional authority to impose such hefty levies without explicit congressional approval. Furthermore, legal challenges are mounting on the grounds that the executive branch cannot unilaterally override the established H-1B visa program through immigration restrictions. As the Department of Homeland Security pushes forward with this regulation alongside other measures like enhanced vetting, the tech and research sectors remain on edge, fearing that these administrative hurdles will severely restrict their ability to recruit global talent to fill critical skill gaps in the U.S. workforce.
