Palestinian Activist Khalil Petitions Supreme Court to Block Deportation
Mahmoud Khalil, a Columbia University graduate and prominent pro-Palestinian activist, has officially petitioned the U.S. Supreme Court to intervene in a legal battle that could lead to his imminent re-arrest and deportation. This move comes after the 3rd U.S. Circuit Court of Appeals ruled that immigration statutes prevent lower courts from blocking his detention. Khalil’s legal team argues that this decision sets a dangerous precedent, asserting that the government is utilizing immigration enforcement to retaliate against noncitizens for exercising their First Amendment right to free speech.
The case centers on Khalil’s 2025 arrest, where authorities invoked specific provisions of the Immigration and Nationality Act to target him for his protest activities on campus. While a lower court had previously ordered his release, the appeals court decision has left him vulnerable to removal to Algeria or Syria, despite his status as a permanent resident with a family in the United States. As the Supreme Court considers whether to hear the case, the outcome could have significant implications for how the judicial system handles claims of politically motivated immigration enforcement, especially as federal appeals courts remain divided on the scope of judicial oversight in such matters.
