Can UAE Employers Deny Annual Leave Extensions? Understanding Your Rights
Under the UAE Employment Law, specifically Federal Decree Law No. 33 of 2021, employees who have completed at least one year of service are entitled to 30 days of annual leave. However, while the law guarantees this leave, it also grants employers the authority to determine leave schedules based on business operational needs. Because the scheduling of leave is effectively at the employer's discretion, they are not legally obligated to approve a request to extend your leave, even if you still have an unused balance.
If you choose to extend your time away without explicit authorization from your manager, you risk serious professional consequences. Beyond losing your salary for the days you are absent, failing to return to work as scheduled without a valid, pre-approved reason could lead to disciplinary action. Under Article 44(8), an employer has the legal right to terminate an employee without notice if they are absent for seven consecutive days or twenty non-consecutive days within a year without a justifiable reason. If you have a genuine emergency, the best course of action is to provide formal documentation or proof of your situation to your employer to see if they will accommodate the extension.
