Understanding Your Maternity Leave Rights in the UAE

In the UAE, mainland employment is governed by Federal Decree-Law No. 33 of 2021, which provides clear protections for working mothers. Under Article 30 of this law, female employees are entitled to a total of 60 days of maternity leave. This period is split into 45 days of fully paid leave followed by 15 days at half pay. Furthermore, employees have the right to request this leave starting from the last day of the month preceding their expected due date, provided they can support the request with a medical certificate.

If an employer refuses to grant these statutory benefits, employees have clear legal avenues to seek justice. The first step is to file a formal complaint with the Ministry of Human Resources and Emiratisation (MOHRE), which will attempt to mediate an amicable resolution between both parties. Should the mediation fail to resolve the issue, the employee has the right to escalate the matter to the competent Dubai courts. These courts are authorized to review the claim and order the employer to honor the leave entitlements, potentially awarding further compensation for any unlawful denial of rights.
