Terminating a Domestic Worker’s Contract in the UAE: What Employers Need to Know
Under UAE law, specifically the Federal Decree-Law No. 9 of 2022, employers do have the right to terminate a domestic worker’s contract before its expiry, provided there is a valid legal basis. Termination is generally permitted if the worker fails to fulfill their obligations as outlined in Article 12, which includes performing duties with due care, following lawful instructions, and protecting the employer's property. Similarly, employers must ensure they have met their own legal responsibilities, such as providing fair wages, medical care, and respectful treatment, as mandated by Article 11, before initiating any separation process.
If you decide to proceed with termination, it is crucial to understand your financial obligations based on the reason for the dismissal. If the contract is ended for reasons unrelated to the worker’s conduct, you are legally required to cover their return flight to their home country and settle all outstanding dues. Should any disagreements arise during this process, both parties are encouraged to seek an amicable resolution or refer the dispute to the Ministry of Human Resources and Emiratisation (MOHRE). Ultimately, employers should document all performance issues thoroughly and complete the necessary residence and work permit cancellation procedures through the official channels to ensure full regulatory compliance.
