India Updates Immigration Rules: New Timelines and Digital Appeals

The Indian Ministry of Home Affairs has officially rolled out the Immigration and Foreigners (Amendment) Rules, 2026, marking a significant shift in how foreign nationals manage their stay in the country. A major highlight of these changes is the update to registration timelines; foreigners seeking to extend their stay must now complete the registration process within 180 days of their arrival, replacing the previous 14-day post-expiry window. While this provides a more generous timeframe for routine compliance, the government has adopted a firmer stance on late filings, which will now be permitted only under documented "emergent circumstances."

Beyond stay extensions, the new rules offer clearer guidance for families with mixed-nationality backgrounds and introduce a more efficient, digitized grievance system. For instance, parents are now exempt from specific registration requirements if they intend to secure Indian citizenship for their children, though they must notify authorities within 30 days if a child acquires foreign citizenship while in India. Furthermore, the government has launched an online portal for filing appeals, ensuring that disputes are handled with greater transparency. With a mandated 60-day window for the Commissioner to resolve these appeals, the administration is clearly moving toward a more modern, time-bound, and accessible immigration framework.
