Navigating Domestic Worker Recruitment in the UAE: Agency vs. Direct Hiring

When looking to hire a domestic worker in the UAE, the Ministry of Human Resources and Emiratisation (Mohre) has highlighted two distinct paths: utilizing a licensed recruitment agency or opting for direct recruitment. Choosing a licensed agency provides a layer of legal security, as these arrangements are governed by specific contracts that offer employers various protections and guarantees under the UAE’s Domestic Workers Law. In contrast, direct recruitment allows employers to bypass agencies by submitting a formal undertaking to Mohre, though this route shifts the full burden of responsibility onto the employer and excludes the legal protections typically afforded by the agency-based model.

The distinction between these two methods is vital, particularly as the government continues to tighten regulations on recruitment offices. Recently, the ministry took firm action against 42 agencies for over 130 legal violations, many of which involved failing to provide mandatory fee refunds to employers. By law, agencies must process refunds within two weeks if a worker leaves or is returned. Ultimately, while direct hiring offers more independence, agency recruitment remains the only path that includes official legal guarantees, making it essential for employers to weigh their need for regulatory protection against the desire for direct control.
