Federal Judge Strikes Down Trump’s H-1B Visa Fee
In a significant legal development on Monday, June 8, a U.S. District Judge in Boston, Leo Sorokin, ruled that the $100,000 fee mandated by the Trump administration for new H-1B visas is unlawful. This high-cost barrier, which was intended to apply to highly skilled foreign workers, has now been officially invalidated following a legal challenge.
The ruling stems from a lawsuit initiated by 20 Democratic state attorneys general, who argued that the fee hike introduced by President Trump last September was beyond his authority. By invalidating this massive surcharge, the court has effectively dismantled a policy that sought to drastically increase the financial burden on companies looking to hire international talent.
