The UAE’s Federal Tax Authority (FTA) has introduced a proactive mechanism allowing companies to secure Advance Pricing Agreements (APAs), providing a formal way to lock in the pricing of transactions between related entities for several years. This initiative addresses the complexities of "transfer pricing," where businesses set values for internal goods, services, and loans. By obtaining official approval upfront, companies can mitigate the risks of audits and penalties that often arise when tax authorities scrutinize intercompany dealings. This is particularly vital for free zone firms, as maintaining a zero percent corporate tax rate depends on proving these transactions are conducted at "arm’s length."
While the current framework is limited to domestic transactions with a minimum value of Dh100 million, it represents a significant step in the UAE’s effort to bolster its status as a premier global business hub. Experts note that while the process requires a substantial investment of time, resources, and a Dh30,000 filing fee, the long-term benefit of fiscal predictability acts as a powerful competitive advantage.
