Dubai’s New Protections Against Deceptive Lease Agreements
Dubai’s Rental Disputes Center (RDC) has introduced a significant legal safeguard for both tenants and landlords, allowing them to void a lease agreement before it even begins if deception is proven. This new principle, anchored in the Civil Transactions Law, ensures that parties are not trapped in contracts built on dishonesty or withheld information. By permitting the annulment of a lease when a party has been misled, the RDC aims to foster a more transparent rental market where legal validity is contingent upon the good faith of everyone involved.
This regulatory shift was sparked by a recent case where a landlord discovered that a prospective corporate tenant had a history of bounced checks, unpaid debts, and outstanding legal orders. Although a lower court initially dismissed the claim, the RDC’s General Authority intervened, ruling that such deliberate concealment constitutes legal deception. To avoid similar pitfalls, the RDC now encourages parties to utilize the "Rental Good Conduct Certificate" available via the Dubai REST app. This free tool allows landlords and tenants to verify the judicial history of the other party, providing a proactive way to ensure security and peace of mind before finalizing any binding commitments.
